VOTING TERMS AND CONDITIONS
This voting system has been set up for you to vote for your favourite motorcycle photograph. The promoter is Bauer Consumer Media Limited (‘Bauer Media’) (Company No. 1176085) with registered office address of Media House, Peterborough Business Park, Lynchwood, Peterborough, PE2 6EA. To vote for your favourite motorcycling related photograph please first read these terms and conditions carefully and follow the procedure specified below.
There may be high volumes of people voting, if you have difficulties getting your vote through the website then please wait and try again within the voting times specified below.
Voting for the top 10 commences on 26th August 2016 and closes noon 21st September 2016. Once the top 10 is confirmed, voting for the top 3 will commence on 5th October and close at noon on 26th October. Votes made outside the voting dates and times specified will not be counted.
Bauer Media may in its sole discretion change the rules for voting at any time.
Voters may vote for 3 different photo’s, however Bauer Media reserves the right to disqualify votes if they have reasonable grounds to suspect that fraudulent voting has occurred.
Voters will not receive confirmation for their vote.
Bauer Media staffs directly connected in any way to Moto fFto are not eligible to vote.
Bauer Media do not accept any responsibility for any votes that may be lost or delayed through technical failure or problems with any telephone network, service provider, system server, website or software or otherwise which may result in any vote not being registered or recorded.
Bauer Media cannot promise that the website will be free from errors or be available uninterrupted and in a fully operating condition. Bauer Media will not be liable to you or to any other 3rd party in the event that all or any part of the website is discontinued, modified or changed in any way.
Subject to the above, Bauer Media does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any voter howsoever arising from participating in voting whether due to any error, omission or other cause by Bauer Media, its employees, agents or others to the fullest extent permitted by law.
The highest number of votes will determine the overall winners.
In the event of a tie the editors of Motorcycle News will decide the winner.
If there is any fault, mistake, misunderstanding or dispute concerning voting or the operation of any part of the voting process the decision of Bauer Media shall be final and no correspondence will be entered into.
Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
These terms and conditions shall be exclusively governed by and construed in accordance with the laws of England and the voter irrevocably submits to the exclusive jurisdiction of the courts of England and Wales.
1. THESE SPECIFIC TERMS AND CONDITIONS
1.1 The MCN Moto Foto competition sponsored by Carole Nash is open to UK and Ireland residents aged 18 or over. Employees of Bauer Consumer Media, Carole Nash and any company associated with MCN Moto Foto competition sponsored by Carole Nash, and their immediate families, are not eligible to enter. Previous winners cannot enter the same photograph again.
1.2 Entrants must provide the entry details as specified when loading a picture. Only 3 images per entrant will be considered for the 100 shortlisted by the judges. Use of false name or address, ie. a name, by which the entrant is not usually known, will disqualify them from receiving any prize. No responsibility can be accepted for lost, delayed, or damaged entries. Any person loading images onto www.carolenash.com/mcnmotofoto will need to keep a high-resolution version of the image. The person uploading must own all the rights to the picture and have permission to upload/use the photo. We reserve the right to amend these rules at any time. Entrants will be deemed to have accepted these rules and to agree to them. No entries can be returned and the promoter will enter into no correspondence.
1.3 The closing date for uploading pictures is midnight 17th August 2016. Judges will decide the top 100 images, and the public vote will start on 26th August 2016, and close on 21st September 2016. Judges voting for the top 10 images will take place between 23rd September-29th September 2016. Alongside "Likes" on Carole Nash Facebook page: www.facebook.com/insidebikes. At noon 3rd October 2016 the 10 most popular and Judges choice photos will be posted to www.carolenash.com/mcnmotofoto and public voting will take place between 5th October and 26th October 2016, to pick the winner, runner up and third place. Voting closes at noon 26th October 2016 Voters must register prior to voting.
1.4 The 3 Winners will be formally notified by 28th October 2016 Only the winners will be contacted personally. The winners will be featured on the Carole Nash stand at Motorcycle Live 2016.
1.5 The winner, runner up and third place will be announced on the Carole Nash stand at Motorcycle Live 2016
1.6 The winner, runner up and third place also need to be available for the Carole Nash MCN Moto Foto competition press call, date to be confirmed. In the event that a winner is not available then the next placed finalist will be selected. Carole Nash will provide reasonable travel costs within the UK and Ireland and accommodation for the evening before the press call plus 2 tickets to the show for the winners and runner up and third place.
By entering your photograph in the competition you are giving permission for your photograph to be used but not limited to appearing within Motorcycle News, on www.carolenash.com/mcnmotofoto, and the wider promotion of Moto Foto.
2.1 First prize £1000 cash prize supplied by Carole Nash. Plus TomTom Rider 410 Premium + Bandit Premium (£800 value)
Second prize £600 cash prize supplied by Carole Nash. Plus TomTom Rider 410 EU (£319.99)
Third prize £400 cash prize supplied by Carole Nash. Plus TomTom Rider 40 WE (£279.99)
2.2 By entering a photograph or voting in Carole Nash MCN Moto Foto competition you are eligible for a free copy of a monthly motorcycle magazine published by Bauer. Available magazines are Bike, Ride, Classic Bike, Performance Bikes and Practical Sportsbikes. This promotion includes free postage. To claim your magazine, simply call 0800 66 54 38 and quote offer code “Nash” or text 78070 and quote “Nash”. Call times are Monday-Friday 8am-8pm and Weekends 10am-6pm This offer cannot be used in conjunction with any other offer. Offer available for UK addresses only and limited to one per household, please allow up to 6 weeks for delivery. 2.4 The promoter accepts no responsibility for resultant loss or damage to persons or properties (other than death or personal injury due to negligence of the promoters or their agents) as a result of these prizes being awarded. We reserve the right to feature the names, photographs, and locations of winners in future promotions.
2.5 Values of prizes are correct at time of going to press. If for any reason, the prize is unavailable Tom Tom will substitute the prize to a greater or equal value.
3.1 We reserve the right to refuse or withdraw entries at any time.
